From 6 April 2017 HMRC’s IR35 legislation was reformed. The impact of this reform directly impacts the income of all those providing services into Public Sector bodies via a Private Services Company (PSC). To enforce the capture of unpaid tax and National Insurance to those limited company contractors, the legislation stipulates that the end engager (i.e. the public sector body) now has to inform the resource supplier in advance of the contract starting what the IR35 position is, with them becoming the fee payer to HMRC where they fail to do so.
SCC works with our clients to assure that they take “reasonable care” in performing the IR35 assessment, and adopt this a part of the standard process to accompany any resource request. IR35 identifies the specifics facts of each individual working arrangement and the legislation tells us that one cannot make a blanket determination for all interim resource as it will be very easy to argue that any client doing so is not acting reasonably in which case they will assume liability for incorrect determinations.
